- Resumen: Un dictamen pericial es un documento en virtud del cual una persona experta en una determinada ciencia, arte u oficio (perito) traslada una opinión (técnica) sobre unos hechos a un profano en la materia o a otro técnico no tan experto como él. Para que los destinatarios del dictamen (en última instancia, el juez, que ha de tomar una decisión e impartir justicia, y los abogados, que encuentran en los dictámenes argumentos de reclamación y defensa) confíen en la opinión del técnico, han de apreciar coherencia interna y verosimilitud en el dictamen, entre otras cosas. Los conocimientos científicos y técnicos que se le presuponen al autor de un dictamen no son suficientes, porque la mejor explicación técnica puede no transmitir adecuadamente su contenido. Por tanto, en la valoración del dictamen pericial de patología en edificación se produce la confluencia de dos ciencias: por un lado, la jurídica, representada por el juez y los abogados y, por otro, la técnica, representada por la figura del perito, y es en este punto de confluencia en el que se centra la investigación planteada. Así, se parte de que es posible y deseable utilizar criterios de argumentación complementarios a los puramente técnicos, para potenciar la transparencia y comprensibilidad del dictamen. Esta tesis presenta las posibilidades que tiene la teoría clásica de la argumentación, dividida en tres planos (dialéctico, lógico y retórico) en la práctica del dictamen pericial relativo a patología en edificación y en base a ella, presenta un modelo de argumentación técnica. Las técnicas de argumentación han sido aplicadas y desarrolladas principalmente en los campos filosófico y lógico y, aunque en menor medida, también en el campo del derecho, entre otros. Sin embargo, a día de hoy, apenas se ha desarrollado su potencialidad en el campo técnico. ----------ABSTRACT---------- A technical report is a document in which a technical expert in a certain science, art or trade makes known their technical opinion thereon to a layman who has no real understanding or to another expert with less knowledge. In order for the addressees (in the end, the judge, who must make a decision to deliver justice, and the lawyers, who find complaints and defense arguments in the reports) to trust the technician’s opinion, it’s necessary for them to appreciate internal consistency and plausibility in the report, among other things. Scientific and technical knowledge, presupposed in the author is not enough because the best technical explanation can not properly transmit its content. Thus, in the evaluation of the technical pathology report a confluence of two sciences takes place: the legal one, represented by the judge and the lawyers, and the technical one, represented by the technical expert. This research focuses on this meeting point. Therefore, it’s possible and necessary to introduce argument criteria, supplementary to purely technical criteria, in order to improve transparency and comprehensibility in the report. This thesis presents the potential of the classical theory of argumentation, divided in three parts, (dialectical, logical and rhetorical), applied to the technical pathology report practice and presents a technical argumentation model based on it. Argument technics has been applied and developed, mainly in the philosophical and logical fields and, although to a lesser extent, also in the field of law, among others. However, to date its potential has hardly been developed in the technical field.
